LOGIN AND PASSWORD 

This service may be accessed only through a login and a password. By agreeing to the terms, you agree that the login and password will not be shared with others. The login and password are for a single user. The user will be responsible for maintaining the confidentiality of the login and password. The user shall be responsible for all logins from their id, whether authorized or not. Unauthorized login or login by multiple users will lead to termination of account.

CONDITIONS OF USE

The user agrees not to use the website for any unlawful purpose or for any purpose prohibited by the terms. The user shall not copy the material except for personal use. The user shall not be permitted to republish the information without prior permission of Global Economic Tracker and or Olive First. The user agrees not to use any software for downloading the documents.

FAIR USAGE POLICY

If the user downloads more than 5 documents a day, the account automatically gets suspended. Global Economic Tracker and or Olive First shall activate the account within 24 hours of getting suspended. If the User is found guilty of downloading more than 5 documents a day, the account shall get permanently deactivated and Global Economic Tracker or Olive First will not refund any amount and has the right to take legal action.

PUBLISH/ADVERTISE

If a user publishes/advertises his/their tenders or business information gathered or collected through public domain, Global Economic Tracker and or Olive First team does not give any kind of guarantee on the accuracy or correctness of the information and does not guarantee any kind of returns.

CONFIDENTIALITY 

Global Economic Tracker and or Olive First team retains all client records and they are not divulged to any third party. In case of a vendor, the information is divulged only with prior permission. The users are required to retain all communication with the Global  Economic Tracker and or Olive First team. In case the client loses the communication, Global Economic Tracker and or Olive First’s team can provide the copy of the same. 

PAYMENT 

The user can make the payment directly through Bank transfer, PayPal, or credit /debit card. Global Economic Tracker and or Olive First has the right to recover the amount in case of a default. Olive First invoices will be due for payment immediately at an agreed time as per terms agreed by the customers. Any delay in payment by customers beyond agreed time will be subject to finance charge @1% per day of the invoice value. 

CANCELLATION POLICY 

A user can cancel his subscription anytime if the account has not been activated or within 24 hours from the date of activation if the user has not logged in even once. A levy charge of 25% will be imposed in case of cancellation due to the fluctuation of currency rates and PayPal/bank charges. A user cannot cancel the subscription if the user has logged in the account or after a period of 24 hours from the date of activation. If user subscribe for a limited period promotion offer provide super savings in that case, if user can cancel his subscription within 24 hours , it will be subject to levy of 25% of subscription cost towards administrative expenses and refund will be credited to customer’s credit card and or bank account within 45 working days from an acknowledgement of cancellation by Global Economic Tracker and or Olive First. No refund if subscription not cancelled within 24 hours. If after limited period promotion offer period over, in that case, if a user subscribes after the promotional offer and if user cancel the subscription will be subject to levy of 25% of subscription cost if subscription cancelled within 24 hours. The refund will be credited to user’s credit card and/or bank account within 45 working days from the acknowledgement of cancellation request by Global Economic Tracker and or Olive First. If subscription not cancelled within 24 hours then no refund. If user avail services under flexi plan, than a user or customer can pay on a quarterly basis with a pre-commitment of 1 year subscription.  Amount will be charged through automatic debit to subscriber’s credit or direct debit customer’s bank account for a period of one year on quarterly basis or any other payment mode. Cancellation levy of 25% of amount paid if cancelled within 24 hours. Refund will be credited to customer’s credit card and/or bank account as the case may within 45 working days from acknowledgement of cancellation by Global Economic Tracker and or Olive First. No refund if subscription not cancelled after 24 hours.

TERMINATION OF AGREEMENT AND REFUND POLICY 

Both the user and or customer and company can terminate the account with a prior notice. Terms and conditions of use Read the terms carefully before using the site. If you do not agree with the terms, do not use the site.

DISCLAIMERS AND LIMITATION OF LIABILITY

Read all tender information or project information or  notices and or any other information carefully. There may be delays, omissions or inaccuracies in the information provided due to the large number of sources for procuring the information. Global Economic Tracker and or Olive First provides the services on as is basis and gives no guarantee on accuracy, correctness or completeness of the information. By agreeing to the terms, you are indemnifying Global Economic Tackers and or Olive First from any and all losses that can occur while using the service. In case of any claim arising, the amount of compensation provided by Global Economic Tracker and or Olive First shall not be greater than the amount paid for the service by the user.

CHANGES TO WEBSITE AND SERVICES

Global Economic Tracker and or Olive First holds the right to make changes (temporary or permanent) to the website without any prior notice. Global Economic Tracker and or Olive First can change or discontinue any service. Global Economic Tracker and or Olive First can change the pricing without giving any prior notice. Global Economic Tracker and or Olive First reserves the right to change or remove any promotional offers. Global Economic Tracker and or Olive First can change any clause of the agreement at any point of time and the continued use of website would imply acceptance to the changes in the agreement.

INDEMNITY 

By agreeing to these terms, you indemnify, hold harmless, Global Economic Tracker and or Olive First and all employees from all liabilities or legal fees in relation to any claim arising out of the usage of the website. 

SEVEREABILITY

In case any provision of the agreement is deemed to be void, voidable or unenforceable by any judicial or competent authority, Global Economic Tracker and or Olive First shall amend the said provision. The remaining provisions shall remain effective and in full force. 

APPLICABLE LAW AND DISPUTE RESOLUTION

Hon’ble High Court of Mumbai, Maharashtra State, India has jurisdiction over all claims arising due to the usage of the services provided by Global Economic Tracker and or Olive First. All claims shall be subject to arbitration. 

GOVERNING LAW AND JURISDICTION

This terms and condition and related policies shall be governed by and construed in accordance with the English law. 

The Parties to any dispute, controversy or claim shall first attempt to settle such dispute, controversy or claim in good faith by whatever means such Parties deem appropriate.  If such Parties cannot themselves resolve any such dispute within thirty (30) days from the time the dispute arose, initial resort shall be had to private conciliation or mediation in a form agreed by such Parties.  If within sixty (60) days after the dispute has arisen a satisfactory private conciliation or mediation process has not been agreed upon by such Parties, or if within ninety (90) days after the dispute has been submitted for private conciliation or mediation it has not been resolved to the satisfaction of such Parties, then the dispute may be submitted to arbitration outside UAE i.e. Mumbai, Maharashtra State, India.

INDEMNITY

The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of www.globaleconomictracker.com and/or www.olivefirst.com or their breach of the terms . 

LIABILITY

User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user’s transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages. 

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent. 

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company’s total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company as subscription, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.
